LAKEVILLE LAKE SPECIAL ASSESSMENT DISTRICTS

There are two special assessments for property owners on Lakeville Lake - the 'Lakeville Improvement Project' which covers aquatic plant control and coordination (weed harvesting, chemical treatment of indigenous or invasive species and professional services) and 'Public Education Information Dissemination, Recreation, Safety, Environmental, Administration and Contingencies’ (newsletters, notices, web-site, fish stocking, creating/maintaining fish habitat, monitoring and maintaining the lake environment).
The applicable Addison Township Ordinances, in particular the Lake Lot District ordinances, restrict riparian rights to one dock and two boats per parcel unless other use is permitted by a Marina Permit, MDNR Boat Access Permit or other legally permitted use. The State of Michigan Inland Lake and Stream Act Part 301 restricts each parcel of land to a dock with maximum dimensions that practically restrict parcel owners to two authorized boats. MDNR Parks Division guidelines start with one parking space, meaning one boat, for every 15 lake surface acres for determining the safe and sustainable number of boats that an inland lake can handle. It is also well documented that the most prevalent method for introducing invasive species to an inland lake is the number of boats ingressing that body of water. The critical purposes for creating the Lakeville Lake Special Assessment District remains the prevention and control of invasive species, environmental administration and recreational safety.
The applicable definition of “Boat” is that as described in the Addison Township code section 74:33 - “Boat means a watercraft having a motor or engine larger that 5 Horse Power.” The official descriptions and assessment calculations are listed below:

SPECIAL ASSESSMENT CRITERIA
1. All parcels of real estate abutting, contiguous, or with direct access without an intervening fee holder interest to the waters of Lakeville Lake, are determined to be benefitted by the lake improvement project and to comprise the special assessment district.
2. The assessment shall be spread against the properties within the district on the following formula:
(a) Each residential parcel, along the lake shoreline, whether vacant or improved (with a single family residential dwelling), shall be assessed $336.00 per parcel which is equal to $168.00 per authorized boat slip, plus an additional frontage assessment of $0.50 per foot of lake frontage over 75 feet.
(b) Each parcel, along the lake shoreline, and used for commercial, multi-family or any other non-residential use, shall be assessed two times the residential rate which is equal to $336.00 per authorized boat slip, plus an additional frontage assessment of $1.00 per foot of lake frontage over 75 feet.
(c) Any parcel that has deeded direct access to Lakeville Lake through a access parcel will be assessed the non-riparian rate of $672.00 plus an additional frontage assessment of $1.00 per foot of lake frontage over 75 feet, to be divided equally by the number of parcels with deeded direct access.
(d) Each parcel along the lake shoreline which exceeds the limit of 2 authorized boat slips per parcel by marina permit or other legal permit, shall be assessed $168.00 per authorized boat slip, plus $0.50 per foot of lake frontage over 75 feet. To date, two marina permits exist allowing 45 and 32 authorized boat slips respectively. For purposes of clear calculation, by MDNR Marina Permit, Johnson and Smith’s Landing are authorized and will be assessed for 45 and 32 boat slips respectively.
(e) Each parcel along the lake shoreline which exceeds the limit of 2 authorized boat slips per parcel by MDNR Boat Access Site (BAS) permit or other equivalent permit, shall be assessed $336.00 per authorized boat, plus $1.00 per foot of lake frontage over 75 feet. The MDNR BAS has 29 parking places for tow vehicles and boat trailers to deliver each boat to the boat slips.
Note, each of the 29 BAS parking spaces represents one authorized boat slip but the nature of each boat utilizing the BAS, is very frequent ingress and egress which exacerbates the introduction of invasive species for which this SAD was created as a counter-measure. Therefore, for the purpose of clear calculation, the Lakeville Lake MDNR BAS shall be authorized and assessed for 29 boat slips.
The Education SAD is estimated to collect $4,389.00 per year and is $19.00 per parcel owner (owners with multiple parcels excluded).
PUBLIC EDUCATION, INFORMATION DISSEMINATION, RECREATION SAFETY, ENVIRONMENTAL, ADMINISTRATION AND CONTINGENCIES PROGRAM
SPECIAL ASSESSMENT CRITERIA
For the Information and Education Program, each parcel will be assessed a flat rate of $19.00. If a person owns more than one parcel, they will only be assessed once.
